I have been offered to buy a 5d2 sample from a dealer. To make a long story short, how is this even possible, I thought shops had to give them back to canon?

Maybe it is their demo model, which they would have bought and should hang onto in order to sell more 5D2s.  Your experience may be an indication that they expect their first multi-unit shipment soon and can therefor afford to let their display unit go for a few days until it can be replenished from the first multi-unit shipment.  Otherwise, selling their display unit would be shooting themselves in the foot as to future sales.
