Title: Yet another copyright question
Post by: PeterAit on February 17, 2016, 11:26:48 am
I am considering setting up a business sideline working with artists who need photos for show submissions, brochures, etc. To help illustrate my website/brochure I am considering taking photos of some items in my own art collection. Would I need permission from the artist to use these photos in my promotional materials?

I would say yes, as you are clearly using it for commercial/advertising purposes.

There's really no question — the artists owns the copyright to their work. This copyright gives them the exclusive right to reproduce the work, prepare derivative works, and distribute copies of the work. Without an agreement the only other way out is fair use, which doesn't seem to apply in your case.

Thanks. I assumed this was the situation, but wanted to check.
