How can the sale of these photos without the consent of the owner be considered fair use?

It is probably not.

Prince's Art is in the appropriation. The piece itself is largely irrelevant, it's about the process and, in part, the legalities involved. At this point, anyways.

The photographer of the stolen(?) image writes, that she knows about the theft and that a print was sold for quite a tidy sum, but doesn't want to press charges?  There has to be more to this entire story than meets the eye.  Just doesn't make sense.

I will not pretend to understand this.

Someone can download someone elses photograph and sell it for $100,000 and yet downloading a DVD for personal use that'd cost £5 at ASDA is illegal.

I htink the problem is that Pricnce has won previous court cases that he thinks he is untouchable, and so do the 'victims' of his appropriation that they think it is not worth going after him.

Actually, he didn't use the photograph.  He used an image of a screenshot of the Instagram posting complete with comments from other people, and from him.

I am betting it falls under fair use.  His comment at the bottom of each of those images might do it.  I'm not even sure his comments were needed, though.

I have no clue why anyone would want Prince's "work".
