Is the subject going too far?
Not when you consider that it now makes photographs taken when stepping onto someone's driveway or front lawn to take a photo of someone breaking into a house inadmissible in a court of law.
The protections this will given corporations that no longer have to worry about journalists sniffing around is also high.
Catch someone at a restaurant or hotel doing something illegal? That photo you took can now not be used in court.
Film someone in a store shop lifting? As a private person, that video you made cannot be used against the thief.
But perhaps the biggest kicker is this...
If a police officer asks you to "move along" then do you still have the legal authority to be there?
Does that effectively give police control over your ability to film them in a public place?
"Sorry sir, you'll need to move back another 50 yards whilst we take care of this matter."
Or if another law establishes an "automatic" 50 yard exclusion zone around a police officer when they have just shot someone.

It certainly seems to be a crazy law

I can't see how this would not be unconstitutional.
-
Many seem to agree with you, but I guess it will rely on the State trying to prosecute someone for the judge to rule it is unconstitutional. Until then I guess it could stay on the statute books just to scare people.
-
On what grounds do you think it is unconstitutional? Being terrible doesn't make a law unconstitutional.

Do you mean what is unconstitutional about the potential limitationf of freee speech or the potnetil to being criminalised for reporting something that is against the public good?

Violation of freedom of speech. I should be able to take pictures of my (public) land and show it to the rest of the landowners (the public) or anyone else I choose.
-
With respect, that is absurd. Taking pictures isn't speech. Showing them to people might well be, but taking them certainly is not. There is absolutely no act of communication in the taking part, or more generally in the data gathering.
The constitution is not a magical document which makes everything you want to do in to speech, and everything you disagree with into restriction of speech.
-
Not so fast, Andrew. Courts have ruled that the public has every right to record police. That is the "taking" part. You can not possibley argue that showing it is free speech, while taking it isn't. Taking it is the integral and necessary part of showing it.

Well said George ! ;D

Legislators pandering to their constituents. That's all. It will be found Unconstitutional. Not only Freedom of Speech but Freedom of the Press to report on what's going on - good and bad. The press is who they really want to stop from reporting on these potential disease problems.
