usage rights celebrity
« on: April 16, 2014, 03:20:35 pm »

I have a little time so I thought I'd ask around here just in case my numbers are way off...

Retired/veteran sports star, female, world champion in her day, big worldwide sport, still a celeb, regularly on TV and at veterans events,  but a low key celeb.
Her agent wants one or two images I did a while back to use as her 'image or brand' for all her appearances/promo's etc... being in sports all her pics online are by sports shooters or paps so not ideal as a brand, mine were done in a studio with a full team etc...

Being a big agent they have been vague on what they want, but lets assume 3 or 5 yrs, unlimited use in arts and media, worldwide.  I know these people and they don't want to be calling me every five minutes to change the usage rights, so 3 or 5 yrs is accurate.

I found images of her of Getty, and ran the numbers and the fee was over $15,000 for pretty unflattering sweaty sports pics.

Just asking if anyone out there  has any similar experiences, or recently done usage rights for a (sports type celebrity) and what the rough numbers are, last thing I want to do is sell my self short or... cave to a lower price as I have no other photographers experiences to call upon.

Any help would be great.

Thanks for the AOP link, I'd forgotten about them.

Alas though it's not really designed for this type of subject, you put a BUR of a lowish 1,000 put in all media, all countries, 3 yrs and the numbers are sky high.

But thanks again, if anything it enforces my gut instinct based on experience and probably more info than I've mentioned here.

Still a tough one to get 'the right price' but all this info helps...

Thanks again.

My BUR was actually ok plenty high enough and realistic but the final
Number way way to high.

Retired world no.1 in one of the top two world sport for women, (golf or tennis maybe track ?)

So it's not like a retired grid iron/baseball/football male who is either a tv pundit or doing the veteran circuit, there are me try of guys but women...? Not many if them. She needs one or two images that she can use for each and every 'event' she does, it could be tv pundit, or the opening if a sports academy, anywhere...

I'll ask them for a budget too...

You should ask a producers at http://blog.wonderfulmachine.com/contact/ and see if they can help you price the usage.

Cheers Ellis, I was on a similar page (lawyer in NYC specialising in copyright and usage rights for photographers).

She's a friend and to be honest as I'm working more Uk/Europe side than NYC side this year I'd forgotten to call her.

In the end it comes down to 'do they really love the image enough' and 'how much is it worth to us'

Steve
Exactly. Uniqueness counts too.
