I think either the client or the photographer will get hammered.
I suspect Getty will dodge this bullet.
Either the photographer (and getty) listed it as editorial and the client misused it, or the photographer listed it as including a model release when it didnt.
I know from my time with Getty that they say they will always ask for consent for any controversial image use as they don expect a standard release to cover something like this.
