Having heard some of the stories about how litigious things can get in the US, I for one would not sign this contract and hand over my rights.

Contracts like this should be resisted and bands like that denied the oxygen of publicity it they are attempting to become copyright thieves.

If you didn't sign, you wouldn't shoot - simple as that.

On the same basis, surely, if I own a Coldplay album (which I don't, because I have taste) would that mean that their copyright was automatically transferred to me and other buyers in perpetuity?  For those of you still claiming "the first album was good" - please, stop deluding yourselves, it was self-indulgent whiny rubbish sung from the tonsils.  Martin's voice as awful and his lyrics somewhat worse.  It's music for inducing suicide.
Funny how everyone thinks their taste is better than everyone else's.

Actually, on a serious note, I think that that is why it is happening - because if I so choose, I can torrent an album and whilst I don't have any legal right to, who is going to stop me?  Since artists' (and Coldplay's) copyright is routinely infringed to the point where for the first time in over 70 years, more money is made from touring than record sales, the value of gig photos increases.  Since the record companies are getting screwed, instead of modernising their business model, they just choose to screw you guys instead.
Particularly stupid as photography helps promote live music, so they should be encouraging photographers not making life more difficult for them, like the moronic 3 song rule.
I bet Coldplay etc don't even know about these copyright grabs. Far more likely to be a control freak Tour manager's lame idea.

So, what is an example of a good band?

In this case, I think they are the "oxygen."

They have created a brand, a persona.  Much as I may not like it, they have the right to control the marketing of that, which is also an extension of themselves.  If the photogs were so important, we would be publishing photos of ourselves instead.

To them it must seem like everyone is out to profit on their image and hard work.

Yeah, I admit that I like Coldplay.   But I am old enough that I don't have to pretend to be cool by being smarmy, pretentious, and cynical. No-one really cares what I think anyway.

Now can we just go back to beating up on Annie because she is so successful?

they are a shit band that write shit music. the Foo Fighter's had the same exact contract, but they say "through out the universe" instead of world.

I love it when they says they paid you $1 for the pictures, but then never give you the one dollar which nulls the contract. Only one band ever gave me the $1, sisters of mercy, but then they never got back to me about running the pictures so they are sitting on my hard drive.

That pretty much describes the last Sisters of Mercy show I saw in 1985.

Liked them before that. Really really boring preprogrammed synth and drum machine trash.... They played with 1, 25 watt bulb for 2/3 of the show, then turned 10,000 wattts on facing the audience. Assholes.  And I was supposed to photograh the show ...

A good band is something that that person likes! Therefore they are then deemed good. Everything else is pants and to be dismissed as rubbish. - That's how most people [naively] work.

It's funny that *you* should say that, of all people (who have posted in this thread).

I just asked because of your dramatic dismissal of Martin as being whiny. I was curious what non-whiny singers you might like. I was not expecting to see both Björk and Tori Amos show up as examples

For posing to?    Besides those last three groups all sound very much like 80s  [alternative] club music to me.  Which was for dancing to.

Again more dance music. Danced to all those artists in fact.

Hi
I was talking to a Cold Play fan & we were talking about the contract. He mentioned that Chris Martin is for "Make Fair Trade". Here is one link
http://theutubeblog.com/2008/05/22/coldpla...ake-fair-trade/
For a band that promotes fair trade... How fair is this? ( contract ) LOL
One thing though I don't think the photographers think this is very funny!

The Pixies were great up until Frank Black (or vice-versa) started dumping on Kim Deal. That's when the humor and goodness in the music disappeared. Most boys don't understand, since they use music to accentuate their Frank Black'ness, rather than empathize...

I would like to add that anyone planning on shooting the newly build House of Blues in boston mass think twice. Unless you go in with the band, if you get in there through the box office and deal with them for the photopass (being on a band's list) you will find that they make you sign a ridiculous contract stating that you will not use the photos basically anywhere including online and if you do put them online, it can't be for more than 30 consecutive days.

How would the venue have the legal right to restrict the image usage? Did the band give them the legal authorization? This does not seem to make since. Would this contract even hold up in court?
