In the end, we shall all have to abandon photography. My own eyes have been repeatedly offended lately by suggestive images purporting to be of snow! As if! Don't need no jury to decide what's going on. Sick, I tell you, sick!

Yeah, that'd have been a privacy violation here in the U.S. too. In a day care center you have an expectation of privacy. Out on the street or in a restaurant, etc., you don't. This is not "street."

Reasonable decision.  The photo of just the leg was found to be OK, for example - not guilty on that one.  If you target the genitals of someone and it's on private property and they haven't consented, it's not unreasonable to consider that a breach of privacy.  In the case of the 17 year old, it's even more questionable (and her being in a school uniform of sorts should have made it clear, notwithstanding that he worked there and would have known as well).

I don't see a problem with this.  It isn't street photography, it's some creep trying to take shots for his own sexual gratification.

Snow, indeed...! An apology of another type of white powder, the use of which is utterly illicit, that's what it was, I tell you. And I don't mean powder sugar, although my cardiologist has advised against my abusing it too.

I have to agree, but would mention that on the street, it too could be a privacy issue.  There have been more then a few guys arrested for photographing up a woman's skirt or between her legs using long lenses while she was walking up stairs, like at the Lincoln Monument.  Park Rangers regularly watch out for those situations. 

I have to agree with the outcome even though I am a photographer. 

Getting in trouble for using an image of the Rock n Roll Hall of Fame or the lighting on the Eiffel Tower though is BS!

Never heard of upskirting before. Sounds like panic during a fire.

Isn't it strange: you are perfectly able to walk about, sit down, bend over and tie up your laces wearing whatever you care to wear, regardless of what you may expose, but should that exposure be snapped - that's illegal!

Can someone please explain why it's okay to show, but not to have what you show recorded? (I am not talking about actively following somebody down a street and holding a camera at her ankles! That would obviously be wrong because 'she' never did intend anyone should see from that angle.) But tell me that a woman doesn't know what she shows when she sits down on a train or bus seat, or at a restaurant table. From the age of six I'm sure she knows, and if not, Mama did a damned poor job!

I cant answer to the first one, but in MA it is now illegal.  I remember this being covered on the news when it happened and the Colbert Report even did a segment making fun of it.

Having someone perhaps randomly noticing something for a fraction of a second or even a few seconds is quite different from having a permanent record created of the event.  That said, if it happened in a public place and was visible to a "reasonable person" it would unlikely be illegal (here, at least).  But on private property with a deliberate effort to get the necessary angle, and knowing that one of the targets was under aged, and not having consent to take any photos of the people in question, it's not acceptable in my view (or the view of the court).  Everyone can have their own view on what's acceptable, of course, but the only one that really matters is the court's.
