Title: Copyright restrictions and recognizibility
Post by: Robert Roaldi on February 28, 2005, 07:16:42 am
I have read previous posts about copyright restrictions and obtaining releases, specifically of private places. I live in Canada but wouldn't mind reading about how the following situation is handled in different countries. At this point, knowledgeable opinion is good enough for me, I don't need airtight legal advice as it is mostly curiousity on my part.

The hypothetical situation is this. I stay at a resort for a weekend and I take a photo of a picturesque porch on their property, or anything else for that matter. There is nothing in the photo that identifies the location. It's just a porch with a nice rocker and weather-stained furniture.

Do I need that resort's written release to sell the print at a photo exhibit?

Do I need their release to put that photo in a book that I publish?  (Not likely to happend anytime soon.)

Do I need their release to put that image on a stock agency site?
